Claudio Visco

(Bar Leaders Open Forum)

(The Role of an Independent Bar in a Resilient Democracy: Perspectives and Practices from Taiwan)」發表英文演講,演講後並受到全場各國律師公會領袖之熱烈鼓掌及讚許。

Distinguished colleagues, fellow Bar Leaders, and friends from around the world. Good afternoon.

Look around this room. Every single one of us here carries the exact same weight on our shoulders. We lead legal professions in times of extraordinary disruption. Across the globe today, we are witnessing a shared, troubling pattern: political polarization is deepening, judicial legitimacy is being questioned, and democratic institutions are being tested like never before.

When people talk about a "resilient democracy," they usually look at written constitutions, free elections, or parliamentary debates. But we know the truth. Constitutions don't defend themselves. When external pressure mounts, when disinformation floods public debate, and when political tensions reach a boiling point—what actually holds the line?

In Taiwan, our answer is simple: An independent, self-governing, and fearless Bar.

In fact, under Article 1 of our Attorney Regulation Act of Taiwan, the mission of a lawyer is not merely to represent clients. The law clearly mandates that lawyers must safeguard human rights, realize social justice, and promote democracy and the rule of law. For us, defending the rule of law is not a side project. It is our statutory duty.

To understand why the Taiwan Bar stands where it is today, we have to look back just a few decades. Taiwan was once under martial law. Civil liberties were restricted, and political dissent was silenced. But during those darkest hours, who stepped into the courtroom to defend dissidents and political prisoners? It was Taiwan’s lawyers.

They knew the risks. They knew defending unpopular clients could cost them their careers, or even their freedom. Yet they showed up. Through decades of struggle, Taiwan transitioned into one of the most vibrant, progressive democracies in Asia. And that journey taught our legal community a fundamental lesson: The independence of the Bar is never a gift from the state. It cannot be granted by royal decree or government generosity. It is earned through public trust, professional courage, and an unwavering commitment to justice.

That is why the Taiwan Bar Association fought for full self-governance—ensuring that ethical discipline and professional advocacy remain entirely free from executive control. Because a lawyer who fears the government cannot protect a citizen against the government.

Now, let’s talk about today. What does our frontline look like in the 21st century? Taiwan sits at the geopolitical epicenter of global supply chains and digital transformation. We face very modern challenges to our democratic resilience. I want to share three concrete ways our Bar Association acts as a shock absorber for democracy.

First: Using Constitutional Law as a Bridge, Not a Weapon

In a polarized political environment, controversial laws often spark massive protests and parliamentary gridlock. When politics fails to resolve disputes, society turns to the Constitutional Court. Here, the Taiwan Bar Association plays a critical role through the Amicus Curiae—the "Friend of the Court" system. Our bar committees step in to submit objective and researched legal briefs. We don't take political sides. We take constitutional sides. By framing emotional political conflicts into disciplined legal reasoning, we help channel social anger back into constitutional normalcy.

Second: Fighting Disinformation and Defending Judicial Legitimacy

What is the easiest target for disinformation? The judiciary. When a controversial verdict is handed down, malicious narratives spread instantly on social media, claiming the judges are corrupt or politically biased. If people stop trusting the courts, the rule of law collapses from within.

This is where the Bar Association acts as an interpreter. We release immediate, accessible public statements explaining the procedural safeguards, the burden of proof, and the legal rationale behind complex decisions. We explain to our citizens: You don't have to like the outcome, but you can trust the process.

Third: Deepening Democracy Through Citizen Participation

Democracy cannot survive as an elite legal sport. It must belong to ordinary people. Recently, Taiwan introduced the Citizen Judges Act, placing regular citizens alongside professional judges in serious criminal trials. For our trial lawyers, this was a massive shift. But more importantly, it allowed lawyers to demystify the law for our fellow citizens. When people can sit in the deliberation room together with judges and deliberate on justice, their faith in democratic institutions grows stronger.

Colleagues, every jurisdiction represented in this room has its own legal system and cultural context. But the challenges facing our profession are borderless. As Bar Leaders, what can we take away from this? Allow me to offer three reflections from our journey:

Number One: Independence is not Neutral Silence

An independent bar must never become an instrument of a political party. But when core constitutional principles, judicial independence, or fundamental human rights are under assault, silence is not neutrality; silence is abdication. An independent bar must have the institutional courage to speak truth to power.

Number Two: External Autonomy Demands Internal Integrity

We cannot demand that the public trust our voice if we do not seriously hold our own profession accountable. The bar’s moral authority to challenge government overreach or criticize judicial procedures stems directly from our self-discipline. Our commitment to strict legal ethics, rigorous conflict-of-interest rules, and transparent disciplinary systems is the foundation of our legitimacy. Public trust is hard to build, easy to destroy, and impossible to command by decree. We must earn it every day through uncompromising professional standards.

Number Three: Cross-Border Solidarity is Our Ultimate Safety Net

Autocracy and populism are cross-border phenomena. Therefore, the defense of the rule of law cannot stop at national borders. When a bar association in any corner of the globe is harassed, when independent judges are wrongfully dismissed, or when defense lawyers are detained for representing their clients, it weakens the fabric of justice everywhere. That is why platforms like the IBA and forums like this are so vital. We need each other's voices, mutual oversight, and collective solidarity.

To conclude, let me leave you with one final thought. Democracy is not a machine that runs on its own. It is fragile. It requires constant maintenance, constant courage, and unwavering protection. In times of calm, lawyers help draft contracts and resolve private disputes. But in times of crisis, lawyers are the ultimate custodians of constitutional order.

Taiwan’s journey proves that even in the face of daunting geopolitical uncertainties, a vibrant democracy can thrive—as long as its legal profession remains independent and committed to the public good. The Taiwan Bar Association is proud of our democratic path. But more than that, we are ready to stand shoulder-to-shoulder with all of you—defending advocacy, safeguarding judicial independence, and keeping the light of the rule of law burning bright across the globe. Thank you very much.
